Terms of Service
General

The customer hereby agrees to observe and be bound by the following terms of service in relation to the provision of the products and services provided by the i010.com:

  1. Definitions and Interpretation
    • In this Agreement, unless the context otherwise requires:

      [Agreement] means the agreement between the i010.com and the Customer in respect of the same kind of Service; an Agreement comprises of the Application as accepted by the i010.com, these General Terms and Conditions of Service as may be amended from time to time and Special Conditions (if any).
      [Application] means the written or oral application made by the Customer to the i010.com requesting for provision of Service to the Customer.
      [Charge(s)] means the charges payable by the Customer in respect of the Service as set by the i010.com from time to time.
      [i010.com] means i010.com (International) Limited.
      [Customer] means any bona fide person including without limitation any individual, government agency, organisation, incorporated or unincorporated company.
      [Minimum Service Period] means the period specified in the Application or Special Conditions and commencing on the day when the i010.com informs the Customer that the Service is made available to the Customer, or if no such period is specified, the period of one(1) months.
      [Equipment] means the hardware/software (including but not limited to: computer, computer parts, computer software, computer programs)
      [Service(s)] means the products/services (including but not limited to: webhosting, webpage design, email service, server co-location service, server rental, application development, application/software rental, any related information technology service and any add-on service) provided by the i010.com.
      [Special Conditions] means those conditions specifically applicable to the identified Services for the time being and from time to time, and if there is any inconsistency between these General Terms and Conditions of Service and Special Conditions, the terms of Special Conditions shall prevail.
    • Words importing the singular number include the plural number and vice versa and words importing masculine gender shall include the feminine and neuter genders and words importing persons shall include corporations;
    • Where two or more persons are comprised in the expressions "Customer", the Agreement herein contained shall be deemed to be made by such persons jointly and severally.
    • Headings are for convenience only and do not affect the interpretation of this Agreement.
    • In the event of any discrepancy between the English and Chinese version of this Agreement, the English version shall prevail.
  2. Provision of Service
    • Subject to the terms and conditions set out herein, the i010.com shall provide and the Customer shall subscribe to the Service.
    • The Customer undertakes not to use, or allow any other person to use, the Service:
      • for any illegal or improper purpose;
      • in a manner which constitutes an infringement of rights of any person (including but not limited to rights of copyright or confidentiality) or a violation or infringement of any duty or obligation in contract, tort or otherwise, to any third party;
      • for the purpose of sending unsolicited advertising material or bulk messages of whatever kind;
      • which interferes with, impedes or impairs the use or operation of, or do anything likely to interfere with, impede or impair the use or operation of Services provided by i010.com; or
      • for purposes not authorised by i010.com.
    • The Service shall commence and shall become chargeable from the date i010.com first makes the Service available to the Customer.
    • Unless the Customer requests otherwise, the Customer is deemed to have consented that:
      • its name, address, business and telephone number(s), email address(s) and fax number(s) be included in i010.com's directories and directory enquiry service and be disclosed to a third party for related purposes; and
      • i010.com may release information concerning the Customer to other service operators, for the purpose of complying with i010.com's obligations to interconnect or other industry practices agreed to by i010.com.
    • i010.com may modify, withdraw, change or reallocate any telephone or service numbers assigned to the Customer. i010.com will endeavour to give the Customer prior notice as may be reasonable and practicable in the circumstances, unless the withdrawal is because of termination or suspension of Service in accordance with the Agreement.
  3. Application for Service
    • All request for provision of Service may be made orally or in writing in the form prescribed by i010.com ("Application Form"). The Application Form may be signed and sent to i010.com either in its original form, by facsimile or by email. If signed and transmitted by fax, the facsimile copy shall to all practical intents and purposes be deemed to be and take effect as the original, whether or not the original form is at the same time or subsequently sent to i010.com. The Customer acknowledges that the Application Form may be scanned by a computer imaging system whereby the information and/or image of the Application Form will be converted into a digital format and stored in i010.com's computer systems. Such stored information may from time to time be reproduced and printed on paper. A hard copy thus reproduced shall to all practical intents and purposes be deemed to be and take effect as the original, and the Customer shall not be entitled to enquire as to whether the original Application Form is still retained or has been otherwise disposed of by i010.com.
    • The Customer agrees to provide all necessary information and documents such as personal identity, business registration as may be reasonably requested by i010.com to assess the Application and thereafter to provide the Service. In the event that the Customer declines to provide such information requested by i010.com, i010.com may decline to provide the service to the Customer.
    • The Customer agrees that i010.com may use or disclose the personal information furnished by the Customer and any information relating to the Agreement to any appointed nominee or agent of i010.com for the purpose of provisioning the Services to the Customer, debt collection, prevention or detection of crime or disclosure as required by law or a government authority and that i010.com shall be entitled to send or otherwise deliver to the Customer certain information in relation to any products or services of i010.com or any of its associated company. i010.com shall not be liable for any act, omission, negligence or default of such nominee or agent.
    • The Service provision lead time is subject to variation depending on availability, geographical location and other relevant circumstances.
    • i010.com shall not be obliged to provide any Services to the Customer. Service provision is subject to geographic availability and credit approval.
  4. Payment
    • The Customer shall punctually pay the Charge without any deduction in the manner and currently indicated on the invoices issued by i010.com to the Customer. The Customer shall be responsible for monitoring and controlling the use of the Service by third party and shall be liable for all Charges incurred through the use of the Services regardless of whether the Customer personally used the Service or whether the Service was used without his authority, knowledge or consent. In the event of any dispute between i010.com and the Customer relating to any charges invoiced by i010.com, the books and records of i010.com shall be conclusive evidence of those charges payable by the Customer.
    • Any enquiries or disputes regarding any invoice must be made to i010.com within 7 days of the issue date of the invoice. Nothing in this clause shall relieve the Customer from paying the Charges on or before the payment due date specified in the relevant invoice.
    • In the event of any invoice being overdue, the Customer hereby authorise i010.com to interrupt, temporary suspend or permanently terminate the service(s) subscribed.
    • i010.com shall be entitled to charge interest on all outstanding amounts under the Agreement at the rate of 2% above the prime lending rate of The Hongkong and Shanghai Banking Corporation Limited as current from time to time calculated from the date on which the same is payable until the date of actual payment.
    • i010.com shall have the right at any time to require the Customer to provide any amount of deposit to i010.com (the "Deposit") as security for due payment of any Charges and performance and observance of the terms and conditions herein stipulated and on the part of the Customer to be performed and observed. The Deposit shall be refunded to the Customer without interest after termination of the Agreement and the settlement by the Customer of all outstanding Charges or claims brought by i010.com in respect of any breach, non-observance or non-performance on the part of the Customer of any of the terms, conditions and obligations under the Agreement.
    • Where the Customer has more than one agreement with i010.com, i010.com may transfer any credit balance under one agreement to pay an amount due under any other agreement.
      • i010.com may employ any person to collect any or all sums owed by the Customer to i010.com under this Agreement in which case i010.com shall not be liable to any act, omission, negligence or default of any such person;
      • The Customer hereby agrees that i010.com may collect, store and disclose details of and information relating to the Customer (including any transactions and dealings between the Customer and i010.com) to any person appointed by it in accordance with Clause 4.g(i) and the Customer agrees that any such person or entity may utilise such information in the course of any business carried on by such person or entity;
      • The Customer shall indemnify i010.com for all cost and expenses incurred by i010.com in employing debt collecting agencies or institutions.
    • In the event that any Customer requests a re-print of any invoice for any or all kinds of Services in addition to the original copy of printed invoice provided to that Customer in accordance with the applicable terms and conditions of the Service (if any), that Customer shall be liable to pay a service fee of not more than HK$50.00 per complete set of re-printed invoice as may be determined by i010.com from time to time.
    • In the event a payment is dishonored due to insufficient funds or otherwise, a HK$100 return fee will be charged to Customer's account. i010.com reserves the right to not to accept any future payment by cheque(s) should cheques are dishonored twice.
  5. Limitations
    The Service is offered subject to the availability of facilities and the provisions mentioned herein. i010.com reserves the right whenever necessary at its absolute discretion to limit the length of communications or to discontinue furnishing facilities owing to conditions beyond its reasonable control.
  6. Interruptions
    i010.com shall use all reasonable endeavors to maintain an efficient Service provided that nothing herein contained guarantees that the Service shall be available to the Customer on demand or continuously in accordance with the terms of this Agreement.
  7. Liability and Indemnity
    • Save and except for any liability of i010.com which cannot be excluded at law, neither i010.com nor any third party service providers which are involved in the provision of the Service shall be liable to the Customer or any other person whatsoever in contract tort or otherwise at law for any cost, expenses, losses, damages or other actual, indirect or consequential losses or liabilities whatsoever, suffered or incurred by the Customer or by other person arising directly or indirectly from or out of or relating to:
      • the provision and/or termination of the Service and/or in any way arising out of or in connection with the agreement under which the Service is provided; and/or
      • any accident or any willful negligent or wrongful act or omission on the part of i010.com and/or the aforesaid third party service providers, their respective agents, employees or contractors, sub-contractors or suppliers in relation to this Agreement; and/or
      • the Customer's use of its own equipment, or any part thereof, which is connected to the network and/or servers of i010.com or of a third party.
    • Customer undertakes to hold i010.com harmless and to indemnify i010.com for any liability, loss, damage, cost or expense which i010.com may incur in connection with this Agreement. In particular, Customer agrees to hold i010.com harmless and to indemnify i010.com for any liability, loss, damage, cost or expense which i010.com may incur as a result of any misleading, untrue or incorrect information or representations which the Customer gives to i010.com in connection with this Agreement.
    • The above clauses 7.a and 7.b shall survive the termination of this Agreement.
  8. Suspension
    • i010.com shall be entitled to forthwith suspend access to the Service without notice to the Customer if:
      • in the reasonable opinion of i010.com there is or has been fraudulent or unauthorised use and access to the Services;
      • the Customer fails to pay in full any charges or other sum whatsoever payable by Customer to i010.com when due;
      • in the reasonable opinion of i010.com, there is any misuse of the Service by the Customer or any other user authorised by the Customer;
      • the Customer is in breach of any of its obligation under the Agreement;
      • the relevant credit limit or usage limit has been exceeded;
      • i010.com is obliged to comply with an order, instruction or request of the Office of the Telecommunications Authority or other competent government authority; or
      • i010.com needs to carry out modification or maintenance services to equipment or systems forming part of the network of i010.com.
    • The Customer will continue to be responsible for all charges incurred between the time of suspension or request for termination of a Service and the actual termination of the Service.
  9. Term and Termination
    • The Agreement shall come into force on and with effect from the date of acceptance by i010.com of the Application and shall continue unless terminated pursuant to the provisions of the Agreement.
    • The Customer may terminate the Agreement by giving to i010.com not less than 1 month's prior notice for the termination to take effect at any time after expiration of the Minimum Service Period. The Customer may terminate before expiration of the Minimum Service Period by given reasonable notice and paying a cancellation charge to i010.com equals to the amount by which the aggregate Charges for the Minimum Service Period exceeds the aggregate Charges already paid by the Customer.
    • i010.com may terminate the Agreement at any time for whatever reason by giving one month's notice to the Customer.
    • i010.com shall be entitled to terminate the Agreement forthwith at any time in the event that:
      • the Customer is in breach of any of its obligation under the Agreement for the Service or other Services and the same remains unremedied for 1 month after notice in writing thereof;
      • the Customer becomes, threatens, or resolves to become or is in jeopardy of becoming the subject of bankruptcy, winding up or receivership proceedings;
      • any permit, license or consent which i010.com may require to possess in order to carry out its obligations under this Agreement being refused or withdrawn, provided however that in any such event i010.com shall give to the Customer the maximum notice practicable in the circumstances then prevailing; or
      • i010.com ceases to make the Services available for whatsoever reason.
  10. Consequences of Termination
    • If the Agreement is terminated by i010.com or the Customer, the Customer shall pay to i010.com all amounts due and payable up to the date of termination as soon as possible from the date of issue of the notice.
    • Upon termination of the Agreement, i010.com shall be entitled to remove the Equipment from the Customer's premises during normal business hours.
    • If the Agreement is terminated prior to the expiry of the Minimum Service Period by the Customer or otherwise by i010.com in accordance with Clause 9.d(1) or 9.d(ii), the Customer shall pay to i010.com the cancellation charge in accordance with Clause 9.b.
    • Termination hereunder shall be without prejudice to any then existing rights and/or claims that i010.com may have against the Customer and shall not relieve the Customer from fulfilling his obligations including payment of all outstanding charges prior to date of termination.
  11. Waiver of Remedies
    Failure or delay of i010.com at any time to take action against the Customer or any other person as provided in the Agreement shall not affect i010.com's right to require full performance of the Agreement at any time thereafter. Waiver by i010.com of a breach of any provision of the Agreement shall not constitute a waiver of any subsequent breach nor in any way affect any right, power or remedy of i010.com under the Agreement.
  12. Assignment
    • i010.com may transfer, assign, delegate or sub-contract any of its rights and obligations under the Agreement.
    • The Customer shall not assign, transfer, convey, license or otherwise dispose of its rights and obligations under the Agreement to any other party without the prior consent of i010.com.
  13. Force Majeure
    i010.com shall not be liable for any loss, damage or delay consequent upon strikes, lockouts, shortage of labour or materials, disputes, delays in delivery of goods or services of any subcontractor, fire, theft, storm, explosion, war, civil commotion, Act of God or any other circumstances beyond its reasonable control howsoever arising or howsoever caused.
  14. Variation
    i010.com may revise the Agreement and/or introduce additional terms and conditions from time to time. Such revision and/or addition shall become effective when displayed on the website of i010.com (http://www.i010.com), and shall be binding on the Customer if the Customer continues to use any of the Services.
  15. Invalidity
    If at any time any provision of the Agreement is or becomes illegal, invalid or unenforceable in any respect, the illegal, invalid or unenforceable provision shall be deemed to have been deleted from the Agreement but other provisions of the Agreement shall remain in full force and effect and shall not be affected or impaired thereby.
  16. Governing Law and Jurisdiction
    This Agreement shall be governed by and construed in accordance with the laws of Hong Kong.

Acceptable Use Policy

As regards to access to i010.com (International) Limited's network ("Services"), i010.com (International) Limited ("i010.com") offers its customers (also known as "subscribers"), and their customers and users, the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information. i010.com respects that the Internet provides a forum for free and open discussion and dissemination of information, however, when there are competing interests at issue, i010.com reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, i010.com has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement and is intended as a guide to the customer's rights and obligations when utilizing i010.com's Services. This AUP will be revised from time to time. A customer's use of i010.com's Services after changes to the AUP are posted on i010.com's website www.i010.com, will constitute the customer's acceptance of any new or additional terms of the AUP that result from those changes.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that i010.com cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that subscribers may acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some materials posted to the Internet is sexually explicit or otherwise offensive. Because i010.com cannot monitor or censor the Internet, and will not attempt to do so, i010.com cannot accept any responsibility for injury to its subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

When subscribers disseminate information through the Internet, they also must keep in mind that i010.com does not review, edit, censor, or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over i010.com's network and may reach a large number of people, including both subscribers and non subscribers of i010.com, subscribers' postings to the Internet may affect other subscribers and may harm i010.com's goodwill, business reputation, and operations. For these reasons, subscribers violate i010.com's policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in the following prohibited activities:

Spamming --Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward i010.com, but also because it can overload i010.com's network and disrupt service to i010.com's subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, i010.com has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.

Intellectual Property Violations --Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. i010.com may remove or block access to customer's content upon receipt of a proper notice of copyright infringement. It is i010.com's policy to terminate the privileges of customers who commit repeat violations of copyright laws.

Obscene Speech or Materials -- Using i010.com's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. In certain jurisdictions, i010.com's affiliate is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, the i010.com's network.

Defamatory or Abusive Language --Using i010.com's network as a means to transmit or post defamatory, harassing, abusive, or threatening language.

Forging of Headers -- Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks -- Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities -Distributing

information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

Facilitating a Violation of this AUP -- Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks, and piracy of software.

Export Control Violations – Exporting encryption software over the Internet or otherwise, to points outside the subscriber's country which is contrary to that respective country's rules and regulations.

Usenet Groups --i010.com reserves the right not to accept postings from newsgroups where i010.com has actual knowledge that the content of the newsgroup violates the AUP.

Other Illegal Activities -- Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.

Other Activities -- Engaging in activities, whether lawful or unlawful, that i010.com determines to be harmful to its subscribers, operations, reputation, goodwill, or subscriber relations. network, system, service, or equipment.

As i010.com has pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the subscriber. i010.com will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with i010.com's policy or applicable laws. When i010.com becomes aware of harmful activities, it may take any action to stop the harmful activity, including but not limited to, removing information, shutting down a website, implementing screening software designed to block offending transmissions, denying access to the Internet, or take any other action it deems appropriate.

i010.com also is aware that many of its subscribers are, themselves, providers of Internet services, and that information reaching i010.com's facilities from those subscribers may have originated from a customer of the subscriber or from another third-party. i010.com does not require its subscribers who offer Internet services to monitor or censor transmissions or websites created by customers of its subscribers. i010.com has the right to directly take action against a customer of a subscriber. Also, i010.com may take action against the i010.com's subscriber because of activities of a customer of the subscriber, even though the action may affect other customers of the subscriber. Similarly, i010.com anticipates that subscribers who offer Internet services will cooperate with i010.com in any corrective or preventive action that i010.com deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of i010.com's policy.

i010.com also is concerned with the privacy of on-line communications and websites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, i010.com urges its subscribers to assume that all of their on-line communications are insecure. i010.com cannot take any responsibility for the security of information transmitted over i010.com's facilities.

i010.com will not intentionally monitor private electronic mail messages sent or received by its subscribers unless required to do so by laws, governmental authority, or when public safety is at stake. i010.com may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, i010.com may disclose information, including but not limited to, information concerning a subscriber, a transmission made using the network, or a website, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation, or governmental request. i010.com assumes no obligation to inform the subscriber that subscriber information has been provided and in some cases may be prohibited by law from giving such notice.

Finally, i010.com may disclose subscriber information or information transmitted over its network where necessary to protect i010.com and others from harm, or where such disclosure is necessary to the proper operation of the system.

i010.com expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of on-line communications. A subscriber's failure to comply with those laws will violate i010.com's policy. Finally, i010.com wishes to emphasize that in signing the service agreement, subscribers indemnify i010.com for any violation of the service agreement, laws, or i010.com's policy, that results in loss to i010.com or the bringing of any claim against i010.com by any third-party. This means that if i010.com is sued because of a subscriber's or customer of a subscriber's activity, the subscriber will pay any damages awarded against i010.com, plus costs and reasonable attorneys' fees.

This AUP helps in clarifying the obligations of Internet users, including i010.com and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP please contact us.

  3. Types of Personal Data Collected
    For the purpose of carrying on i010.com's business including sale, provision, registration and administration of i010.com's webhosting and related products and services (including relevant on-line services), the information that i010.com collects include but is not limited to the following:
    • your name;
    • service installation address, correspondence address and/or billing address;
    • account details, including account numbers, service numbers or user accounts;
    • payment details, including credit card information, bank account and other banking information;
    • contact details, including contact name and fixed and cellular telephone number and email address(es);
    • information for the verification of your identity, including identification type and identification number;
    • a note or recording of a call that you made to i010.com's office;
    • an email or letter you send to i010.com; and other records of any contact you have with i010.com;
    • your account information, such as dates of payment, account balance, the service plans you have subscribed; and any other information relating to your account.
  4. Use of Customers' Personal Information
    The Company may use an analyse your information for the following purposes including but not limited to:
    • for the daily operation of the i010.com's services provided to customers;
    • conducting credit checks when required;
    • designing services or products for customers' use;
    • processing your order and providing the products and services that you have purchased and/or subscribed from i010.com and keeping you updated the progress of your order;
    • keeping you updated of i010.com's latest offers or promotions;
    • keeping you informed of i010.com's products and services including but not limited to webhosting, webpage design, email service, server co-location service, server rental, application/software development, application/software rental, other information technology products and add-on services.
    • assisting you with any products or services enquires, including investigating and resolving service affecting issues and dealing with any billing queries you may have;
    • billing you for using i010.com's products or services;
    • protecting i010.com's network including managing the use of services, emails, files, server, data transfer, related application/software and other use of i010.com's network;
    • analyzing usage of i010.com's network, products and services by you and other customers so that i010.com can further improve i010.com's products and services and/or better tailor the type of products and services presented to customers;
    • carrying out research and statistical analysis and monitoring customer use of i010.com's network, products and services on an anonymous or depersonalized basis;
    • assisting i010.com in fraud and crime prevention;
    • debt tracing, debt recovery and credit management;
    • contacting you if necessary.
  5. Retention of Personal Data
    i010.com will destroy any personal data it may hold in accordance with it's internal policy. Personal data will only be retained for as long as i010.com need it unless the personal data is also retained to satisfy any applicable statutory or contractual obligations or for the purpose of investigation, detection and prosecution of crime.
  6. Disclosure and Sharing of Personal Data
    All personal data held by i010.com will be kept confidential but i010.com may disclose information about you to the following parties:
    • domain registrar(s) and/or SSL Certificate Issuer(s);
    • contractors, agents or suppliers who are involved in delivering the products and services you have ordered or used;
    • any banking or financial institutions, charge or credit card issuing companies;
    • credit information or reference bureaux;
    • debit-collection agencies or other debt-recovery organizations;
    • professional adviser (which shall include lawyers and auditors);
    • any agent, contractor or third party service providers who provides administrative, networks, computer, payment or other services to i010.com in connection with the operation of its business;
    • law-enforcement or government bodies, regulatory bodies, courts or as required by law;
    • any person to whom i010.com is under an obligation to make disclosure under the requirement of any law binding on i010.com or under and for the purposes of any guideline issued by regulatory or other authorities with which i010.com is expected to comply;
    • third party reward, loyalty and privileges program providers;
    • business partners of i010.com; and
    • external service providers (including but not limited to mailing houses, data processing companies and information technology companies) that i010.com engages for the purposes set in paragraph 4.
  7. Security of Personal Data
    • i010.com has adequate measures to protect your personal information from unauthorized access, accidental loss or destruction.
    • if i010.com has a contract with another third party organization to provide a service on its behalf, i010.com will ensure they have appropriate security measures and only process your information as i010.com has authorized. Those organizations will not be entitled to use your personal information for their own purposes. i010.com will take reasonable steps to check these organizations to make sure that they are meeting the security requirements set by i010.com.
  8. Transfer of Personal Data Outside of Hong Kong
    At times it may be necessary and/or prudent for i010.com to transfer certain personal data to other companies or service providers outside of the Hong Kong Special Administrative Region(“Hong Kong”). This may happen if i010.com's servers or suppliers and service providers are based outside of Hong Kong. i010.com will take steps to ensure that your personal information is used by such third parties in accordance with this policy.
  9. Your Privacy Rights
    • In accordance with the terms of the Personal Data (Privacy) Ordinance (“the Ordinance”) and subject to exemptions specified in the Ordinance, any customer:
      • has the right to check whether i010.com holds personal data about him or her and has right to receive copies of such data;
      • has the right to require i010.com to correct any personal data relating to him or her which is inaccurate; and
      • has the right to ascertain i010.com's policies and practices in relation to personal data and to be informed of the kind of personal data held by i010.com.
    • In accordance with the terms of the Ordinance, i010.com has the right to charge a reasonable fee for procession a data access request.
